Land Use Labs LLC (“LLC”) respects your privacy. Please read this Privacy Policy carefully before you access or otherwise use this website (the “Website”), our applications, APIs, databases, and products (collectively, the “Products”), our social media (the “Social Media”), and any other interactions you have with us, by email or otherwise (altogether being the “Contact Points”). By accessing or using the Website, using the Products, accessing the Social Media, or otherwise interacting with us, you confirm that you have read and understood this Privacy Policy, and you consent to all actions we take with respect to your information consistent with the Privacy Policy. 

1.  Definitions.  References to “you”, “your,” and similar terms refer to you, as the user of the Website. References to “us”, “we,” “our,” and similar terms refer to LUL. References to “Personal Information” includes information identifying you as an individual or information relating to an identifiable individual, including any or all of the following: name, address, location, telephone number, email address, company name, professional role, IP address, and payment card information.

2.  Our Approach. LUL is committed to protecting the privacy of visitors to and through our Contact Points and to ensuring that any Personal Information is kept safe. While no data transmission service is completely secure, we have undertaken reasonable organizational, technical, and administrative measures to protect your Personal Information and ensure it is kept confidential and secure. 3.  How We Retain Information. We may use, collect, retain, and share Personal Information about your use and interaction with the Contact Points through your use and interaction with the Contact Points. We need to collect Personal Information to provide you with access to our webpages, services, or uses. The Website, Products, and Contact Points are not directed to individuals under the age of thirteen; we do not knowingly communicate with any person under the age of thirteen; and we do not knowingly collect Personal Information from individuals under the age of thirteen. We retain your Personal Information only for so long as necessary for the purposes set out in this Privacy Policy, unless a longer period is required by law.

4.  Consent to Personal Information Use. By using the Contact Points, you consent to our using, collecting, retaining, and sharing (with LUL-affiliated parties or third party service providers) any information that we may collect from your visits to and through the Contact Points, for the following purposes: accomplishing our business purposes generally, providing you with information, delivering the services or uses you request, assessing your eligibility for any Promotion (as that term is defined in the Terms of Use), refining functionality, retaining records, analyzing Contact Points usage, monitoring security, and achieving other purposes relevant to the functionality, accuracy, legality, or management of LUL and its Contact Points. We may retain information regarding you or your use of the Contact Points for as long as: you use the Contact Points, retention is needed for the functionality of the Contact Points, or retention is needed for compliance with legal requirements described in Article 5.   

5.  Acknowledgement of Legal Requirements. By using the Contact Points, you acknowledge that there may be situations in which we may be required to retain or share some aspects of your information including your usage off the Contact Points to comply with applicable legal requirements, such as government regulations and law enforcement requests, to protect our and others’ rights, to resolve disputes, to achieve a business transaction or sale, or to enforce our legal terms or policies.

6.  Other Information. If you access the Contact Points, you also consent to our use, collection, and disclosure of other information that does not reveal your specific identity or relate to any identifiable individual which we may collect through your use and access of the Contact Points. This other information includes the following information to the extent it does not contain and is not intermingled with Personal Information: browser and device information, usage data collected through your use of the Contact Points, cookies and other technologies, demographic information that does not reveal a specific identity, and aggregated information.

7.  Modifications. We reserve the right to change this Privacy Policy at any time without notice, and we will post the most current version on our site. We will endeavor to notify you if changes may affect your substantive rights, but it is your responsibility to review this Privacy Policy of use periodically for any changes. Your continued use of the Contact Points after any changes to this Privacy Policy will constitute your acceptance of such changes. If you disagree with our changes, then you must stop using the Contact Points.

8.  Your Options. You may opt out of marketing-related emails from us by following the instruction on such emails. You may also contact us using the contact information in Section 10 if you do not wish for your Personal Information to be shared with third parties for marketing purposes, or if you wish for your Personal Information to be deleted from our files. We will comply with any such request as soon as reasonably practicable.

9.  Other Jurisdictions. We implement appropriate safeguards to ensure that our treatment of Personal Information complies with data protection laws in other countries. Depending on your location and applicable law, you may have the right to:

  • Access and/or have the right to know the Personal Information we hold about you;

  • Request that we correct, update, delete, or obtain a copy of your Personal Information;

  • Object to or restrict the processing of your Personal Information, including opting out of the sale or distribution of your Personal Information and the right to limit use and disclosure of sensitive Personal Information (e.g., California);

  • Exercise the right to appeal decisions relating to your privacy rights requests (e.g., Colorado, Connecticut, and Virginia);

  • Withdraw your consent at any time, where processing is based on your consent;

  • Lodge a complaint with a supervisory authority in your state or country of residence; and

  • Extend the definition of Personal Information where applicable and appropriate (e.g., in California per Cal. Civil. Code § 1798.80).

The contents of this Privacy Policy, taken together, are intended to satisfy the requirements of the California Consumer Protection Act, the General Data Protection Regulation, and the UK General Data Protection Regulation.
